For accounts opened before October 15, 2026, these Terms take effect on November 14, 2026.

Introduction

These Terms of Service ("Terms") govern your use of koach.ca and the koach Solo service. koach.ca is operated by Koach Fitness, a sole proprietorship registered in the Quebec enterprise register (in French, Koach Conditionnement Physique) ("koach," "we," "us," "our").

By creating an account or purchasing koach Solo, you agree to these Terms. If you do not agree, please do not use the platform.

If you joined the private beta on Individual or Semi-Private training, your beta continues under the terms you accepted (version 1.1), which stay available at koach.ca/terms-of-service/?version=1.1.

When you purchase a plan, you also receive your own written contract by email and in your account. It states your plan, its start date, its duration, its rate, the total, and how to cancel, and it includes a cancellation form. If your contract and these Terms ever differ, your contract applies.

These Terms are written in plain language. Nothing in them limits any right you have under the Quebec Consumer Protection Act or the Civil Code of Quebec.

1. The service: koach Solo

koach Solo is self-guided online personal training, designed and monitored by a certified koach. You train on your own schedule; your koach builds your program and follows your progress.

1.1 What koach Solo includes

Onboarding and health screening — a PAR-Q+ and a Health and Lifestyle Questionnaire, reviewed by your koach
A movement and fitness assessment — completed by you, on video where requested, and reviewed by your koach
A periodized training program built for you from your screening, goals, assessment and equipment
Your program card — every session, exercise, set and demonstration video, with a place to log what you did
A new program at each training block, built from your progress and reassessment
One live Program Review with your koach for each new program — a video call of up to one hour to go over your program (see Section 5)
Weekly check-ins — a short form you submit; your koach reads it and adjusts when needed
Your dashboard — journal, progress tracking and assessment history

1.2 Plans and prices

All prices are in Canadian dollars.

The weekly rate is the same for the whole duration of your plan. The price of your plan does not change during its term.

1.3 Other koach services

Live one-on-one and semi-private training are not offered for sale at this time. When they are, these Terms will be updated before any purchase is possible.

2. Eligibility and your account

2.1 Age

You must be at least 18 years of age to create an account or use the service. When you register, you confirm that you are 18 or older.

2.2 Accurate information

You agree to give accurate, current and complete information about yourself, including your date of birth and your health information, and to keep it up to date. Your program is built on it.

2.3 One account per person

Each person has one account. Do not share your sign-in details. If you think someone else has used your account, email hello@koach.ca right away.

2.4 Health screening and medical clearance

Before your program is built, you complete the PAR-Q+ and the Health and Lifestyle Questionnaire. If your answers show that medical clearance is needed, your program begins once you provide written clearance from a physician. See the Health Disclaimer at koach.ca/health-disclaimer/ and the Assumption of Risk and Informed Consent at koach.ca/waiver/.

3. Payment

3.1 When your service starts, and why your first payment is taken then

Your service starts the moment your account opens, at your first payment. From that moment you have access to your account, your onboarding and health screening, and your assessment, and your koach begins reviewing what you submit and building your program.

We explain this because Quebec's Consumer Protection Act does not allow a trainer to collect any payment before the service begins. Your first payment and the start of your service happen together.

3.2 Monthly payments

Your plan is paid in equal monthly payments, charged to your payment method on the same day of each month as your first payment, at the start of each month of service.

3 Month and 6 Month plans are paid in 3 or 6 equal monthly payments. We do not offer a single payment for the whole plan, and we do not offer a discount for paying at once: the Consumer Protection Act does not allow either for this kind of contract.
Month-to-Month is one month of service at a time, paid at the start of each month, and continues until you cancel.

3.3 Payment processor

Payment is processed by Stripe. Your card details go directly to Stripe and are never stored on our servers.

3.4 Taxes

koach is not registered for the GST or the QST and charges no sales tax. The price you see is the price you pay. If that changes, we will tell you at least 30 days ahead, and tax would apply only to payments made after that date.

3.5 Failed payments

If a payment fails, Stripe retries it over the following days and we email you. If it still cannot be collected, we may pause your access until it is resolved.

4. Cancelling, refunds and the end of your plan

4.1 You can cancel at any time

You can cancel at any time, for any reason. In your account, under your plan, choose Cancel. You will be offered two choices:

End on your paid-through date. You keep full access until the end of the month you have already paid for. No further payment is taken. Nothing is refunded, because you receive the whole month.
Cancel now. Your service ends immediately and we refund the unused part of the month you paid for (Section 4.3).

You may also cancel by sending us the cancellation form attached to your contract, or any other written notice, to hello@koach.ca or to the address shown on your contract. A cancellation sent this way takes effect the moment you send it and is treated as "Cancel now."

4.2 What you owe when you cancel

Before your service has started: nothing.
Month-to-Month: only the service you received. There is no cancellation fee.
3 Month and 6 Month plans: the service you received, at your plan's weekly rate, plus a cancellation fee equal to the lesser of $50 or 10% of the price of the service you did not receive. This is the maximum the Consumer Protection Act allows, and we never charge more.

Example: you cancel a 6 Month plan at the end of your second month. Four months remain, worth $276. Ten percent is $27.60, which is less than $50, so the fee is $27.60.

When the fee is charged. If you choose to end on your paid-through date, the fee is charged to your payment method on that date, and not before; if you reactivate your plan before that date, no fee is charged. If you choose "Cancel now," the fee is taken from your refund; if the fee is larger than the refund, the difference is charged to your payment method. Your cancel screen shows the exact amounts before you confirm.

4.3 Refunds

When you choose "Cancel now," we calculate the service you received by the day, at your plan's weekly rate divided by seven, and refund the rest of what you paid for the current month, less the cancellation fee where one applies. Refunds are issued to your original payment method within 10 days of your cancellation.

4.4 When a 3 Month or 6 Month plan ends

Your plan ends on its end date. It does not renew by itself. Before it ends, we email you to tell you the date and how to continue.

If you want your plan to continue without interruption, you can turn on auto-renew in your account at any time before the end date. Auto-renew is off unless you turn it on. If it is on, your plan renews for the same duration at the price shown in our reminder email, you receive a new contract, and you can turn it off at any time before the renewal date.

4.5 What you keep after your plan ends

Your account and your dashboard remain yours. You keep access to your journal, your progress tracking, your assessment history and your session history, at no charge. The coaching features end with your plan: your active program, new programs, weekly check-ins reviewed by your koach, and Program Reviews.

4.6 If we end your plan

We may suspend or end your account if you seriously breach these Terms — for example by giving false information about your age or health, sharing your account, harassing your koach, refusing to sign the Assumption of Risk and Informed Consent, or not paying. You owe only the service you received. Anything you paid beyond that is refunded within 10 days.

If we end your plan for a reason that is not your breach — for example if we stop offering the service — we refund the full unused part of what you paid, with no fee.

5. Your Program Review

5.1 What it is

Each new program includes one live Program Review: a video call of up to one hour with your koach to go over your program. You book it from your dashboard when your program is ready.

5.2 Showing up matters

Your koach reserves that hour for you, and it cannot be given to someone else at the last minute. So:

Change or cancel at least 24 hours before your call, from your dashboard, at no cost.
Book at least 24 hours ahead.
Confirm your call. We send you a reminder two days before. If you have not confirmed 24 hours before the start time, the booking is released and you can book another time.
If you miss your call, or cancel less than 24 hours before it, your Program Review for that program is delivered in writing instead of live. You still receive your review.
The first time, we let it go: once per plan, a late cancellation or a missed call is forgiven and you can rebook your live call.
Your koach can always restore a live call when something truly unavoidable happens.

5.3 An additional live Program Review

You can book an additional live Program Review at any time for $50, charged when you book. This is an optional extra, available to every koach Solo client.

5.4 Recording

Please do not record a call without your koach's agreement. We do not record calls. If we ever need to, we will ask you first.

6. Your responsibilities

By using koach.ca, you agree to:

complete the PAR-Q+ truthfully and obtain medical clearance where it is required;
sign the Assumption of Risk and Informed Consent before your program begins;
train safely, and stop any exercise that causes pain, dizziness or distress;
tell your koach about injuries, health changes or medication changes that could affect your training;
use your equipment safely, in a space with enough room;
answer your check-ins truthfully;
treat your koach with respect, in calls and in writing.

7. Intellectual property

7.1 What is ours

The platform, the dashboard, the exercise library, the coaching briefs, the demonstration videos, the program structure and the site design belong to koach or are licensed to us. During your plan you may use them for your own training. You may not copy, republish or resell them, use them to coach other people, or use the koach name or logo without written permission.

7.2 What is yours

Everything you upload — assessment videos, photos, messages, check-in answers — remains yours. You allow us to store and use it only to provide your coaching, for the periods stated in our Privacy Policy. We do not publish it, sell it, or use it to train artificial intelligence models.

7.3 Testimonials

If you offer a testimonial, we publish it only with your written consent. You may withdraw that consent at any time and we will remove it within 30 days.

8. Our responsibility to you

8.1 Our standard

Your koach is a certified personal trainer. Your screening, assessment and program follow a recognized Canadian professional standard for personal trainers.

8.2 Your rights are not limited

Nothing in these Terms excludes or limits our liability for our own acts. In particular, under article 1474 of the Civil Code of Quebec, no contract can exclude or limit liability for bodily or moral injury, or for intentional or gross fault.

8.3 Results

Training results depend on many things, including your effort, your consistency and your body. We commit to the quality of our coaching; we do not promise a specific result such as a given weight loss or strength gain.

8.4 The risks of exercise

Exercise carries inherent risks. The Health Disclaimer and the Assumption of Risk and Informed Consent explain them and what we ask of you.

9. Disputes and governing law

9.1 Talk to us first

If something is wrong, email hello@koach.ca. We answer within 10 business days and will try in good faith to resolve it with you.

9.2 Governing law and courts

These Terms are governed by the laws of Quebec and the federal laws of Canada that apply there. Any dispute may be brought before the competent courts of Quebec, as the law provides. We do not require arbitration.

9.3 Language

These Terms are available in French and in English.

10. Changes to these Terms

We may change these Terms to clarify them, to reflect a change in the law, or to describe a change in how the service works.

The price and the duration of a 3 Month or 6 Month plan are never changed during its term.
For any change that adds to your obligations or reduces ours, we send you a written notice at least 30 days before it takes effect, showing the new wording and the old. You may refuse the change and cancel your plan, at no cost and with no cancellation fee, by telling us no later than 30 days after the change takes effect.
Earlier versions of these Terms are kept and available on request.

11. The documents that apply

Your contract, these Terms, the Privacy Policy, the Cookie Policy, the Health Disclaimer and the Assumption of Risk and Informed Consent together make up our agreement with you. If a court finds one clause invalid, the rest remain in effect.
